My sister come to the US an stay over her visa.. Im a citizen in the US i filed for my mother an sister ( but my sister is still in the US an my mother is in Jamaica).. My question is when the papers come thru. Will it be a problem for my sister to get her green card?

As long as the papers were filed before April 30 2001 if your sister is still in the US she would have to pay the $1,000 penalty she should be able to remain here and adjust her status.

The United States will have jurisdiction over you if youve lived here from at least on year. You can definitely apply for a divorce in the US if you have been living here for a while. You do not need to return to Jamaica to get divorced. The important thing is to get your husband to sign the papers.

Fiance visa situation
I met my current boyfriend 5yrs ago he is jamaican and was over here on a tourist visa. recently he went back and got into some trouble for trafficing to curacao. The charges were dropped, but the usa cancelled his visa when he tried to come back saying that he would have to show proof that the charges were dropped. I Have the papers from curacao saying that they were dropped, so now we are going to try for a fiance visa do you think those charges will affect our chances of getting approved?

Interview resulted in Review
On my interview everything went perfect except when I explained that I got arrested for Kidnapping back in 2002 but was not convicted. Actually DA dismissed it before the first court even went on, but anyways, I gave the Immigration Officer ALL the ORIGINAL Documents from the disposition and police report and said she needed time to review it and that they would notify me within 90 days. My question is....Since I didn't fail no civics test,nor did I not provide them with sufficient information, What can be the result of this?Could it be that they will call me for another interview?or can they grant me my citizenship after review?

My pending I-130 Petition for married Son & daughter
I want some information about My pending I-130. My father who is US citizen submit I-130 last year Nov 2006. Returning to the U/S.
Hello,
I am a U.S.C. and I have a daughter by a Jamacian Citizen who was deported last year. We have been together for 7 years prior to his deportation.
He went through 2 drug proceedings, prior to the deportation hearing, and both drug charges were dismissed; however, he was convicted of Moral Perpetuted, telling a gov. agent he was a u.s. citizen, and orderd to be removed from the U.S. I am not sure if the judge said he could not return for 10yrs. or if he could not change his status for 10yrs. If the case is that he cannot change his status for 10yrs. do you think he will be allowed a visitors visa? Also, if we decide to get married can we apply for a finace' visa, or if we get married in Jamaica, do you think he will be allowed to come to the states.

Contract Law
I paid to go on a trip and photograph models,and Shoot with 5 top photogs and learn from. I got to Jamaica there was no top five and I was told I had to sighn a contract to shoot. There was no mention of said contract before ariving in Jamaica. I signed under duress. Now since it was signed in Jamaica and not the US does it have any legal binding in the US. There is no international claim in contract any where.

Adoption question
i came to the us with a tourist visa which we overstay and expired , while i was on it my biological mother abandoned my sister and me who at the time were 8 and 15 , now my aunt and uncle who are american citizens adopted both of us when we were 10 and 17 now we went to 2 different lawyers who told us that i couldnt get residency because i was too older than 16 when the adoptioin occurred so after knowing this my parents didnt claim me , now im 22 years old now and i found out that i qualify as long as im the sibling of the younger adopted child , my sister is 15 at the moment , my adopted parents got divorce but i still got no status ... now my question is who would claim me to have an status im very confused ..please help

Ans:
Assuming you are a US Citizen, you may petition for your wife as long as she can show she entered the US legally. It does not matter that she overstayed her visa. You would need to file a petition on your wifes behalf to qualify her as a permanent resident.

If your dad is subject to the ten year bar he would need a waiver for you to sponsor him before the end of ten years. If the waiver is granted his petition should be approved, otherwise you need to wait until after ten years.

Why is it 22 more years wait for the Philippines compare to other countries which has less population and I presume less visa petition? Can you please shed some light on this?


Ans.
Different countries like the Philippines and Mexico have unusually high backlogs. The Dept of Homeland Security has determined that these immigrants are overrepresented in the US. While this may seem unfair only new legislation will change this. Typically the petition for a sibling takes longer than any other petition.

Ans:
You certainly may adopt this child. You will need consent from both biological parents for the adoption. Once the adoption is complete you may petition for the child as the adopted child of a US Citizen. Assuming you are a US Citizen. The process is fairly simple. Under the new immigration laws this child would be considered a derivative citizen after she gains permanent resident status again assuming you are US Citizen.

Hello. Please tell me,I am planning on returning to the US next year on internship and I wanna know if I can enroll in a masters program at a university while I'm here? The internship should last for 18 months and I believe I will be under the J1 status when i return. Do I have to have a different kind of visa to enroll into classes?. I heard that after a while or after completing the internship program I can apply to become a US resident, is that true?

Ans:
Your father should apply for citizenship before filing a petition for you to become a permanent resident. Although the process will take a few years because you are over 21, it will still be a lot faster for him to petition for you as a US Citizen than as a permanent resident.

Permanent resident filling for unmarried child over 21
Hi
I am a permanent resident and filed I130 for my unmarried child over 21 in Nov 2005. They live in Iran an i live in Atlanta with my oldest child. the case is in california center. i want to know how long it takes to be approved? in the uscis website says they are processing Feb 2005 in california center. after the case is approved and send to NVC what is the maximum lenght of time it can be there to get the interview. Thanks

I file I30 for my two children over 21,Nov of 2006,how long will it take for them to hear anything from immigration. There are in Jamaica and iam legal residence. My daughter has a child after i file , what should she do when she hear anything? OR WHAT I SHOULD DO?

leaving the Usa
I've been in the USA for about 3 years and im not an american citizen but i have my 3 year old son who is an american citizen,and im planning on returning to the caribben to live,will it be a problem at the airport immigration,if i take my son with me,because i overstayed but would like to take my son back to the caribbean to live with me......thank u in advance.

jamaican or american divorce
I am a 23 year old american who is married to a jamaican man. I petitioned for him to come to the us. During the time of filing, my husband lost his job therefore I paid for his visa..all of it. During that time we were going through difficult times together. His visa was finally granted and he came here for three months and has gone without any intention of coming back. I would like to file for divorce. But I don't know if I have to file for divorce in Jamaica or here? Also,since he is working, I would like to request spousal maintenance, to cover for the expenses that he has placed pon me. Is this possible?
